BACOLOD City – Businesswoman Kate Brios, lawyer Jomax Ortiz and several others who were charged with murder and frustrated murder by Atty. Erfe del Castillo for the alleged ambush against her vowed to get back at the latter.
This, after a Regional Trial Court here dismissed for insufficiency of accusatory evidence the charges filed by del Castillo against Brios, Ortiz, Police Lt. Col. Richie Yatar, PO3 Ronald Ortiz, SPO2 Joshua Barile, Police Inspector James Adrian Albaytar, and one John Doe.
The case stemmed from what Del Castillo claimed was an ambush against her and her fiancé, a former policeman, on Dec 21, 2018.
Del Castillo is currently an assistant provincial prosecutor of Negros Occidental.
Del Castillo survived the alleged ambush, but her fiancé died.
Brios told the Daily Guardian Monday that she will sue Del Castillo for damages.
Ortiz said he will do the same.
He also said that those who del Castillo implicated will also sue the latter.
In a decision released Oct.16, 2020, RTC Branch 52 Presiding Judge Eduardo Sayson said that “considering insufficiency of accusatory evidence that would approximate the findings of probable cause to issue warrant of arrest, the above entitled cases are hereby deemed dismissed.”
